1. Acceptance of Terms

By accessing or using the KodaGO platform (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service. KodaGO operates as a peer-to-peer ride-sharing platform connecting drivers and passengers across Manitoba, Canada.

2. Description of Service

KodaGO is a technology platform that connects registered drivers with passengers seeking rides within Manitoba. KodaGO is not a transportation company and does not provide transportation services directly. We facilitate connections between independent drivers and riders.

• KodaGO does not employ drivers as employees or agents
• All transportation arrangements are between drivers and passengers directly
• KodaGO provides a platform for scheduling and coordination only

3. Eligibility

To use KodaGO, you must:

• Be at least 18 years of age
• Have a valid, active email address
• Provide accurate and truthful personal information
• Be legally permitted to use ride-sharing services in Manitoba
• Not have been previously banned or suspended from KodaGO

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Provide accurate, current, and complete registration information
• Notify KodaGO immediately of any unauthorized use of your account
• Not share your account with any other person
• Not create more than one account per individual

5. Passenger Responsibilities

As a passenger using KodaGO, you agree to:

• Be present at the agreed pickup location at the scheduled time
• Treat drivers and other passengers with respect
• Not engage in disruptive, offensive, or illegal behaviour
• Wear a seatbelt at all times during the ride
• Pay agreed-upon fares promptly and honestly
• Provide accurate pickup and dropoff location information
• Not bring prohibited items, substances, or illegal goods into any vehicle
• Report safety concerns immediately through the platform

6. Payments and Fees

All prices listed on KodaGO are set by individual drivers and are in Canadian Dollars (CAD). By booking a ride, you agree to pay the listed fare.

• Payments are arranged directly between drivers and passengers
• KodaGO may charge drivers a platform subscription fee
• Refund policies are at the discretion of the individual driver
• KodaGO is not responsible for disputes over payment between users

7. Prohibited Conduct

The following activities are strictly prohibited on KodaGO:

• Fraudulent or misleading activity
• Harassment, abuse, or threatening behaviour
• Discriminating against users based on race, gender, religion, disability, or any protected characteristic
• Using the platform for illegal transportation of goods or persons
• Providing false reviews or ratings
• Circumventing the platform to avoid fees

8. Limitation of Liability

KodaGO provides the platform on an "as is" basis. To the fullest extent permitted by applicable law, KodaGO disclaims all warranties and shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to accidents, injuries, loss of property, or disputes between users. KodaGO's total liability shall not exceed the amount paid by you to KodaGO in the twelve (12) months preceding the claim.

9. Privacy

Your use of KodaGO is subject to our Privacy Policy. By using the Service, you consent to the collection, use, and sharing of your information as described in our Privacy Policy. We take the security of your personal data seriously and comply with applicable Canadian privacy laws including PIPEDA.

10. Termination

KodaGO reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Manitoba, Canada.
