1. Overview
This Insurance Disclosure Policy explains the insurance responsibilities of drivers and passengers using the KodaGO platform in Manitoba, Canada. KodaGO operates as a peer-to-peer ride-sharing coordination platform and does not underwrite, arrange, or provide any form of insurance coverage to any party involved in a ride booked through our platform.
2. KodaGO's Limitation
KodaGO expressly states that:
- KodaGO does not provide liability insurance for drivers
- KodaGO does not provide passenger injury or accident coverage
- KodaGO does not provide coverage for vehicle damage resulting from rides arranged through the platform
- KodaGO is not responsible for any claims, losses, damages, or liabilities arising from rides facilitated through the platform
3. For Drivers — Insurance Responsibilities
As a driver on KodaGO, you bear full responsibility for maintaining appropriate insurance coverage. Here is what you must know:
3.1 Manitoba Public Insurance (MPI) / Autopac
All vehicles registered in Manitoba are required by law to have basic Autopac coverage from Manitoba Public Insurance. This provides some protection, however:
- Basic Autopac does cover injuries sustained in vehicle accidents under Manitoba’s no-fault system (PIPP)
- However, standard personal auto policies may exclude coverage when the vehicle is used for commercial or ride-sharing purposes
- You are responsible for verifying your coverage with MPI or your insurer
3.2 Recommended Steps for Drivers
- Notify MPI or your private insurer that you are using your vehicle for ride-sharing activities
- Ask specifically whether your policy covers ride-sharing or peer-to-peer transportation use
- Consider purchasing a commercial or ride-sharing endorsement if available
- Keep proof of insurance with you at all times while operating rides
- Ensure your insurance is current and has not lapsed before accepting any ride
Warning: Failure to disclose ride-sharing use to your insurer may result in your insurance claim being denied in the event of an accident.
4. For Passengers — What You Should Know
As a passenger on KodaGO, you should be aware of the following:
4.1 Personal Injury Protection
Manitoba’s Personal Injury Protection Plan (PIPP) — administered by Manitoba Public Insurance — provides no-fault accident benefits to all people injured in vehicle accidents in Manitoba, regardless of who is at fault. This includes passengers in privately-operated vehicles.
- PIPP covers medical expenses, income replacement, and rehabilitation
- Coverage applies to all road accidents on public roads in Manitoba
- You do not need your own vehicle or insurance to be covered under PIPP as a passenger
4.2 What Passengers Are Responsible For
- Personal belongings are not covered by any insurance through KodaGO or the driver
- You ride at your own risk and agree to hold KodaGO harmless for any incidents
- You should verify that the driver is a verified KodaGO member before boarding
5. In the Event of an Accident
If you are involved in an accident while using KodaGO:
- Ensure everyone's safety first. Call 911 if there are injuries.
- Call the police if required (accidents causing injury or significant damage)
- Exchange names, licence plate numbers, and insurance information with all parties
